These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” or “Customer”) and BKM Ventures LLC (“Plumb,” “we,” “us,” or “our”) governing your access to and use of the Plumb website, applications, and shop drawing review services (collectively, the “Service”). By creating an account, submitting a drawing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old and authorized to enter into these Terms on behalf of yourself or the entity you represent. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
2. The Service
Plumb provides automated documentation review of shop drawings against configurable checklists. Output is provided as informational findings and markups intended to assist your internal review process. Reviews are returned within 24 hours; very large or complex packages can take longer. We may update, modify, or discontinue features of the Service at any time.
3. NOT engineering, code-compliance, or PE review
Plumb is not a licensed engineering firm. The Service is not engineering, not a code-compliance determination, and not a substitute for review by a licensed Professional Engineer, Engineer of Record, Architect of Record, or Authority Having Jurisdiction. Findings flagged as “PE-Review-Required” must be reviewed and approved by an appropriately licensed design professional before any corrective action is taken or relied upon. You are solely responsible for final fabrication, installation, and compliance decisions.
4. Customer content and license
You retain all rights, title, and interest in the drawings, files, and other materials you submit (“Customer Content”). You represent and warrant that you have all rights necessary to submit Customer Content to the Service and that doing so does not infringe any third-party right.
You grant Plumb a limited, non-exclusive, worldwide license to host, process, transmit, and display Customer Content solely as needed to operate the Service and produce your review. We do not use Customer Content to train artificial-intelligence models and we do not sell Customer Content.
Retention. Source drawings are deleted from Plumb-controlled storage thirty (30) days after upload. Finished deliverables (the marked-up PDF and Excel comment log) are retained for ninety (90) days after delivery, after which the dashboard download links expire and the files are deleted. Both windows are enforced automatically.
5. Subscriptions, fees, and billing
Plans, sheet allowances, and rates are described on our Pricing page and are incorporated by reference. Current plans are Anytime Review (pay per package), Standard ($199/month, 100 sheets), Shop ($499/month, 300 sheets), Studio ($1,199/month, 750 sheets), and Enterprise (custom). Subscription fees are billed in advance on a monthly or annual basis, are non-refundable except as expressly stated, and are exclusive of applicable taxes. Annual plans are billed at eleven months’ price for twelve months of service.
Anytime Review is a single package priced from its page count before payment: $25 for packages up to 12 sheets, then $2.00 per sheet. The price is shown at checkout and nothing further is billed afterward — there is no sheet pool, no expiry, and no overage. Anytime Review covers Tier 1 and Tier 2.
Overage. Sheets submitted above a monthly plan’s allowance are billed at a flat $1.50 per sheet, the same rate on every subscription plan and every review tier, and appear on your next invoice. Unused sheets roll over one period on Standard, Shop, and Studio. Tier 3 specification parsing is $200 one-time per client specification; that parsed specification is then reused on every later Tier 3 review for that client at no further charge.
Free month. Monthly plans begin with a 30-day free trial covering up to 50 review sheets, whichever comes first. A payment method is required up front and you will not be charged during the trial. The plan converts to the paid subscription you selected at the end of the trial unless you cancel before then. One trial per customer.
Money-back guarantee. Anytime Review purchases carry a money-back guarantee: if you are not satisfied with your first review, email hello@plumbreview.com within 14 days of the purchase date and we will refund the package in full. The guarantee covers Anytime Review only, applies to your first review on the package, and is limited to one refund per customer.
Cancellation. Your subscription renews automatically until canceled. You may cancel at any time from the billing portal in your dashboard, or by contacting hello@plumbreview.com before the next renewal date. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for partial periods.
6. Acceptable use
You agree not to:
- Submit content that you do not have the right to submit, or that infringes intellectual-property, privacy, or other rights;
- Use the Service to violate any law or regulation, or to upload malicious code;
- Reverse-engineer, scrape, or attempt to derive the source code or underlying algorithms of the Service;
- Resell, sublicense, or provide the Service to third parties without our prior written consent;
- Interfere with the security, integrity, or performance of the Service.
7. Intellectual property
The Service, including all software, checklists, branding, and documentation, is owned by Plumb and its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted, no rights are transferred to you.
8. Confidentiality and subprocessors
We treat Customer Content as confidential and protect it using reasonable administrative, technical, and physical safeguards. Mutual NDAs are available on Studio and Enterprise plans.
We use the following subprocessors to operate the Service: Stripe (payments), Supabase (database, authentication, and file storage), Anthropic (the model that performs the review), Modal (the compute that runs the review pipeline), Resend (transactional email), Vercel (web hosting), and GitHub (source control). 9. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted operation. Plumb does not warrant that the Service will identify every error, omission, or non-compliance in your drawings. You assume full responsibility for verifying findings and for all fabrication, installation, and permitting decisions.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Plumb, its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Service, even if advised of the possibility of such damages. Plumb’s aggregate liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts paid by you to Plumb in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Plumb and its affiliates from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) Customer Content; (ii) your use of the Service; (iii) your violation of these Terms; or (iv) your violation of any law or third-party right.
12. Suspension and termination
We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees when due, or use the Service in a manner that creates risk to Plumb or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including Sections 4, 7–11, and 13–15.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts. Each party waives any right to a jury trial. Any claim must be brought within one (1) year after it accrues or be permanently barred.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by posting the revised Terms here and updating the “Last updated” date, and where appropriate by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Miscellaneous
These Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and Plumb regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent.
